Newly Introduced Legislation - March 6, 2026

House Bills

H. 5126 – Would provide revenues to meet the ordinary expenses of state government for the fiscal year beginning July 1, 2026. This is the yearly “General Appropriations” bill that would regulate the expenditure of funds and provide for the operation of state government.  

H 5127 – A Joint Resolution that would appropriate monies from the Capital Reserve Fund and would allow unexpended funds that are appropriated to be carried forward to succeeding fiscal years and expended for the same purposes.  

H. 5310 – Would prohibit land application and, in certain circumstances, the sale of sludge generated from a municipal, commercial, or industrial wastewater treatment plant. 

H. 5312 – Would prohibit the disclosure of certain personal identification information of a contributor within certified campaign reports that are filed with the State Ethics Commission. 

H. 5313 – Would enact the “Eliminate Illegal Immigration Whistleblower Act” to provide penalties for the employment of unauthorized noncitizens. The act also would provide a civil enforcement process with whistleblower procedures and protections.  

H. 5318 – Would allow the Department of Revenue to issue special permits to establishments that would authorize the purchase and sale for the on-premises consumption of beer and wine for occasions or events held on the grounds of the establishment outside of its normal hours of business operations.  

H. 5320 – Would require a person or entity engaged in the breeding or sale of dogs for profit to register with the South Carolina Secretary of State. Animal rescue organizations also would be required to register with the county in which they operate. Additionally, the bill would define “nuisance barking,” require dog ownership methods, and require proof of ownership to release an impounded dog or cat to its owner.  

H. 5321 – Would establish the “Horse Creek Regional Public Service Authority” within certain portions of Aiken, Edgefield, and Saluda counties and would establish the authority’s primary functions and powers regarding wastewater and sewage services. The legislation also would authorize the regional authority to enter into contracts with the counties and political subdivisions within Aiken, Allendale, Bamberg, Barnwell, Calhoun, Edgefield, McCormick, Orangeburg, and Saluda counties for such services. As of Sept. 30, 2026, the Aiken County Public Service Authority shall be abolished, and all its assets and liabilities must be transferred to the Horse Creek Regional Public Service Authority.  

H. 5322 – Would expand the ability to pay a delinquent tax from a defaulting taxpayer to apply to other individuals or entities in situations relating to the redemption of real property and the assignment of a purchaser’s interest in the property.  

H. 5323 – A House resolution that H. 4216, relating to Income Tax, is set by special order for immediate consideration of Senate amendments to the bill following second reading of H. 5127, Capital Reserve Fund Resolution, and continuing every day thereafter until its disposition; and that H. 3368, relating to tax conformity, is set by special order for immediate consideration following final disposition of H. 4216 and continuing every day thereafter until its disposition on second reading. And, that after third reading of H. 5127, Capital Reserve Fund Resolution, H. 3368 is set for special order on third reading and continuing every day thereafter until its disposition on third reading. 

H. 5327 – Would prohibit an individual from voting in a partisan primary election if they are not a registered member of that party and require the State Election Commission to assist county boards in capturing this data and maintaining it. 

H. 5329 – Would prohibit an employer from requesting an applicant to disclose a criminal history that has been expunged. 

H. 5330 - Would prohibit an individual from voting in a partisan primary election if they are not a registered member of that party and require the State Election Commission to assist county boards in capturing this data and maintaining it. 

H. 5331 – Would increase the motor vehicle user fee that goes to County Transportation Committees to 5.91 cents, and delete the requirement that 25% percentage of “C” funds be used on the state highway system. 

Senate Bills

S. 973 – Would expand the ability to pay a delinquent tax on real property to any other individual or entity. 

S. 979 – Would expand a county’s use of the transportation penny to include greenways and all accompanying infrastructure and services necessary to provide access to these facilities including sidewalks, multipurpose paths, traffic signals, and relocation of utilities. It also expands drainage facility maintenance, and capital improvements for flooding prevention and mitigation relating to mass transit systems, greenbelts and greenways. It allows a county to include ballot language for extension of the tax or replacement for the tax, explaining to voters the measure is not a new tax.  

S. 980 – Would include special purpose districts in the definition of “employer.” 

S. 981 – Would allow certain unprepared foods that are eligible for purchase with food stamps to be exempt from certain federal regulations 

S. 983 – Would require eviction filings and records that include personal information of a defendant to be automatically removed from the public index after 5 years, if no subsequent evictions have occurred.
