Newly Introduced Legislation - Feb. 20, 2026

House Bills

H. 5200 – Would establish that joint custody is presumed to be in the best interest of a child in the context of family court proceedings. 

H. 5201 – Would enact the “Safe Schools Act of 2026” to provide mechanisms to ensure the safety of students and create a multijurisdictional school safety task force that includes a local law enforcement representative appointed by the governor.  

H.5202 – Would prohibit the sale of nitrous oxide with exceptions for appropriate use. 

H. 5204 – Would amend definitions associated with homeowners’ associations and provide additional regulation and oversight of homeowners' associations. 

H. 5206 – Would outline circumstances that must be considered when a health insurer wishes to use artificial intelligence to make determinations relating to prior authorizations. 

H. 5208 – Would provide that certain unprepared foods eligible for purchase with food coupons are not limited to certain federal regulations. 

H. 5209 – Would provide certain requirements for social media companies. 

H. 5215 - Would enact the "South Carolina Ratepayer Protection and Large Load Customer Infrastructure Accountability Act." Part of the bill would require local governments to hold public hearings prior to offering incentives to potential large utility load customers, such as data centers. 

H. 5216 – Would limit application of the 2009 edition of the International Energy Conservation Code to construction that falls within the scope of the International Residential Code. For all other types of construction, the edition of the International Energy Conservation Code is subject to adoption by the South Carolina Codes Council in accordance with Section 6-9-50 as the Energy Standard. It also would allow a local jurisdiction to appeal to the South Carolina Building Codes Council on statewide modifications to the Energy Standard for construction not falling within the scope of the International Residential Code, including emergency modifications, in the same manner as other building codes adopted by the South Carolina Building Codes Council pursuant to Chapter 9, Title 6. 

H. 5218 - Would update the documents necessary to file for damages based on construction claims and raise the standard of proof for such claims. 

Senate Bills

S. 930 – Outlines that in any civil action to recover damages for health care treatment or services, the plaintiff has the burden of proof to offerevidence to prove the amount of the damages he claims.  

S. 931 – Would require the South Carolina Department of Labor, Licensing and Regulation (LLR) to conduct a final inspection upon completion of the installation, modification or alteration of a single, private residence dwelling elevator before it can be placed into service. LLR must also create and maintain a database of single, private residence elevators registered with the department.  

S. 935 – Would require the Department of Public Health to create an informational pamphlet or poster for state and local governmental entities on rendering seizure first aid to an individual who has suffered a seizure in the workplace. The poster or pamphlet must be posted in the workplace in a conspicuous location frequented by employees. 

S. 939 – Would allow a non-vested member of the Police Officers Retirement System who dies in the line of duty to receive a one-time lump sum benefit payment equal to the greater of his accumulated contributions or $75,000. 

S. 941 – Would remove the requirement that at least 25% of “C” funds must be used on the state highway system.
