EPA and Army Corps of Engineers to formally withdraw the 2015 Waters of the US Rule

The EPA and Army Corps of Engineers recently announced that they intended to formally withdraw the 2015 Waters of the US Rule (WOTUS). The rule would have expanded the definition and scope of waterways regulated under the clean water act. In 2014, SCAC staff submitted public comments opposing the rule at the direction of the membership. The rule would have potentially brought many county storm water control systems under federal environmental regulation. With the withdrawal of the rule, regulation will revert to the rules as they existed prior to the 2015 adoption of the WOTUS rule. The EPA has announced it expects to release a revised rule this fall that will be narrower in scope.
