Welcome
to our web site. In South Carolina, the probate court is
the only court in which to initiate an action concerning the
estate of a deceased person, the will of an individual, the
estate of a minor, the estate of an incapacitated person,
involuntary commitment of individuals to institutions, or
matters of trust. The probate court is also responsible
for issuing marriage licenses.
There
is a probate court in every county, and the probate judge is
selected by popular election to a four-year term. County
council may provide funding for one or more associate probate
judges who are appointed by the probate judge.
